End User License Agreement

This End User License Agreement (“EULA”) covers the RouteSurvey App mobile application (“Application”). Swiss Digital Solutions LLC d.b.a. Route Survey App is the licensor and owner of the Application’s intellectual property. It serves North American customers; Swiss Logistics Consulting GmbH serves customers elsewhere and operates the Application’s supporting services, Web Console and sign-in. Payments are handled by the LLC through Stripe.
By installing or using the Application, you agree to this EULA and the applicable Terms of Service. You must be at least 18 and authorized to act for any organization you represent. The Privacy Policy describes data processing.
This is the Application license for the app launch. Visiting the website or joining the waitlist does not activate this license, start a product trial or authorize a payment.
1. The Application
The Application is licensed, not sold. It supports route surveys and reporting on compatible iOS and Android devices. It is not designed for uses requiring HIPAA, FISMA or GLBA compliance. This agreement does not promise current availability in any app store or region.
2. Scope of License
Subject to this EULA and your applicable subscription, you receive a non-exclusive, non-transferable, non-sublicensable license to install and use the Application on devices you own or control, in accordance with applicable store rules and permitted organization use.
You may not copy, rent, sell, sublicense or redistribute the Application, circumvent its security or reverse engineer it except as permitted by applicable law. A violation may result in suspension or termination.
3. Technical Requirements
You are responsible for compatible equipment, connectivity and operating-system requirements. Requirements may change with updates. Offline features do not remove the need to synchronize records or maintain your own exported copies.
4. Maintenance and Support
RouteSurvey App is responsible for Application support through support@routesurvey.app. SLC operates the supporting product services. Apple and Google do not undertake RouteSurvey App’s maintenance or support obligations.
5. Use of Data
The Privacy Policy describes accounts, survey content, device permissions, product providers, payments, retention and your rights. Product hosting and storage of survey photos and reports use OVHcloud in the United States. Use of the Application does not automatically enroll you in a newsletter.
6. Your Content
You or your organization retain ownership of submitted surveys, photos, reports and other content. You must have the rights and permissions necessary to collect, upload and share that material. Workspace permissions and sharing choices determine who can access shared content.
7. Permission to Process Content
You permit the relevant RouteSurvey App company and its service providers to host, process, render, transmit and display content as needed to provide the Application and related services, fulfill your sharing/export instructions, maintain security and meet applicable legal obligations. This permission follows the Privacy Policy’s retention rules and does not grant a perpetual right to resell private survey data or use it in advertising.
8. Safety, Risk and Liability
Do not interact with the Application while driving or operating a vehicle. Stop safely before interacting or have a passenger carry out the survey work. You are responsible for safe operation, professional judgment and independent verification of survey information.
To the extent permitted by law, you accept the risks of your use and agree to indemnify the relevant RouteSurvey App company and its personnel against claims arising from your unlawful or unsafe misuse. This does not exclude liability that cannot lawfully be excluded.
Liability for ordinary negligence is limited, where permitted, to foreseeable damages typical of the contract arising from breach of an essential obligation. No exclusion applies to gross negligence, willful misconduct, fraud, death, personal injury or any other liability that applicable law does not allow us to exclude or limit.
9. Warranty
The licensor warrants that the Application is free from malware when supplied and functions as described in its applicable documentation. This warranty does not cover unauthorized modifications, improper use or failures caused by matters outside its control. Mandatory warranties and remedies under applicable law are preserved.
10. Product Claims
The relevant RouteSurvey App company, rather than the app store, handles claims concerning the Application, including applicable product-liability, regulatory and consumer-protection claims. Send claims to support@routesurvey.app; we will direct them to the responsible company.
11. Legal Compliance
You must comply with applicable laws, export controls and sanctions. You represent that your use is not prohibited by applicable US embargoes or restricted-party rules.
12. Termination, Cancellation and Deletion
This EULA continues until terminated. It may terminate if you breach its terms; on termination you must stop using the Application and remove it from your devices. Subscription cancellation, renewal, the 14-day trial and refunds are governed by Terms section 6.
The Privacy Policy governs the 30-day product retention windows, account-deletion requests and export access. Individual team-member account deletion preserves organization-owned shared records. Uninstalling the Application alone does not cancel billing or delete server-held data.
13. Intellectual Property
The Application and its associated intellectual property remain the property of Swiss Digital Solutions LLC or its licensors. Customer content remains owned by the customer or organization as explained above.
14. Third-Party Terms and Beneficiaries
You must follow applicable third-party terms when using the Application. Where required by the applicable store agreement, Apple or Google and their subsidiaries are third-party beneficiaries entitled to enforce the relevant mobile-license provisions. This does not transfer RouteSurvey App’s product or support responsibilities to them.
15. Governing Law and Disputes
Texas law governs for North American customers; Swiss law governs for customers elsewhere. Mandatory protections under applicable law remain available. Terms section 16 supplies the corresponding regional dispute-resolution provisions. This EULA does not impose Texas law on customers outside North America.
16. Severability
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
17. Agreement and Contact
This EULA and the applicable Terms govern the Application license and related service use. This EULA controls a conflict specific to the mobile license; the Terms control general subscription and service matters. The Privacy Policy explains data handling.
