Terms of Service

These Terms cover the RouteSurvey App website, mobile application, Web Console and related services that link to them (the “Services”). Swiss Digital Solutions LLC d.b.a. Route Survey App serves customers in North America; Swiss Logistics Consulting GmbH serves customers outside North America. “We,” “us” and “RouteSurvey App” refer to the relevant company according to its role.
Swiss Logistics Consulting GmbH operates the mobile app, Web Console and account sign-in. Swiss Digital Solutions LLC handles RouteSurvey App payments through Stripe. Both companies’ contact details appear in section 25.
The Privacy Policy explains data handling. The End User License Agreement additionally governs the mobile application. For a conflict specific to the mobile application license, the EULA controls; these Terms govern general service use and subscriptions. The same regional governing-law rule applies to both documents.
1. Services and Eligibility
RouteSurvey App provides route-survey capture, planning, reporting and sharing tools. You must be at least 18 years old and have the legal capacity to enter into these Terms. If you act for an organization, you must be authorized to bind it.
By using the Services, you agree to these Terms. If you do not agree, do not use the Services. The Services are not designed for uses requiring compliance with HIPAA, FISMA or GLBA; do not submit data requiring those specialized controls.
The public website currently accepts waitlist registrations. Joining the waitlist does not guarantee access, a launch date, a particular feature or a quoted price, and does not begin a trial, subscription or payment. We send the release notification you requested; newsletters require a separate opt-in.
2. Intellectual Property
The Services’ software, design, trademarks and original materials belong to their owners or licensors. The mobile application's intellectual property belongs to Swiss Digital Solutions LLC. Subject to these Terms, you may use the Services and permitted downloads for your own internal business purposes.
You may not copy, sell, sublicense or exploit our software or branding beyond the permissions expressly granted or applicable law. Customer surveys, photos, reports and other uploaded content are addressed in sections 8 and 9; we do not acquire ownership of that content.
3. Your Responsibilities
You must provide accurate account and billing information, keep it current, use the Services lawfully and hold the necessary rights to information you upload or share. You must not misrepresent your identity, authority or affiliation.
RouteSurvey App content and public tools support planning and professional work. They do not issue permits, determine route feasibility or replace current agency requirements, site investigation or qualified professional judgment. Independently verify information before using it for a movement or engineering decision.
4. Accounts and Organizations
Keep your credentials confidential and notify support@routesurvey.app if you suspect unauthorized access. You are responsible for authorized use of your account. Organization administrators manage membership, permissions and organization-owned records.
Deleting a team member’s account removes their account and access, while preserving the organization’s shared surveys, photos and reports under the organization’s retention rules. An individual account-deletion request does not authorize deletion of another person’s or organization’s records. Personal-information requests concerning shared records are handled separately.
5. Purchases and Payment
Swiss Digital Solutions LLC d.b.a. Route Survey App handles payments through Stripe. Accepted payment methods and the applicable price, currency, billing period and taxes are shown when you purchase. Published website prices are in US dollars unless stated otherwise.
You agree to provide accurate billing details and pay the charges you authorize. We may correct billing errors and will communicate applicable price changes as required by law. Joining the public waitlist does not authorize Stripe to charge you. Your statement description may vary; contact support if you need help identifying a payment.
6. Trials, Renewals and Cancellation
The product subscription and retention terms in this section apply at the app launch. The public website currently collects waitlist registrations; joining does not begin product access, billing or a retention countdown.
Product trials last 14 days. You are not charged unless you choose to upgrade to a paid subscription. Without an upgrade, trial access ends and subscription access is suspended. Waitlist registration does not start this trial.
Paid subscriptions automatically renew for the billing period you select unless cancelled. Request cancellation through support@routesurvey.app. Cancellation takes effect at the end of the current paid period. Purchases are non-refundable except where a refund is required by applicable law.
After the paid period ends, product data is retained for 30 days for downloads or export requests, then deleted from active systems. After an unconverted trial expires, trial data is retained for 30 days for export requests through support; trial access does not continue. See product data retention for account deletion, organization records and exceptions.
7. Prohibited Activities and Safe Use
- Do not interact with the app while driving or operating a vehicle. Stop safely before interacting, or have a passenger perform the survey work.
- Do not gain unauthorized access, impersonate another user, circumvent access controls or interfere with the Services.
- Do not upload malware, unlawful material, unsolicited advertising or material that infringes privacy or intellectual-property rights.
- Do not harass users or staff, misuse support channels or obtain another person’s credentials or data through deception.
- Do not scrape, automate access, resell accounts or redistribute the Services without authorization.
- Do not remove proprietary notices or reverse engineer the software except where applicable law permits it.
8. Customer Content and Sharing
You or your organization retain ownership of surveys, observations, location records, media, templates and reports submitted to the Services. Obtain any rights, permissions and notices needed to collect or upload personal information about others.
Content is shared through the workspace permissions and sharing functions you or your organization use. Recipients may retain downloaded copies. You are responsible for choosing appropriate recipients and for the content you publish or share. We may restrict unlawful content or access that violates these Terms.
9. Permission to Process Content
You grant us and the service providers acting for us a non-exclusive permission to host, copy, process, render, transmit and display your content as necessary to provide the Services, fulfill your sharing and export instructions, maintain security and meet applicable legal obligations.
This permission lasts only as needed for those purposes and the retention periods in the Privacy Policy. It does not authorize us to sell your surveys or use private customer content in advertising. Feedback you voluntarily provide may be used to improve the Services; feedback does not transfer ownership of your survey records.
10. Mobile Application License
The mobile application is licensed under the EULA. Applicable app-store rules also apply when you obtain it through a store. References to store rules do not mean the app is currently available in every store or region.
11. Service Management
We may monitor compliance, investigate abuse, protect systems and suspend access for violations or security concerns. We will handle retained customer data according to the Privacy Policy and applicable law. These Terms do not promise uninterrupted availability or a particular service level.
12. Privacy and Hosting
The Privacy Policy explains collection, use, sharing, retention and privacy requests across the Services. SLC operates the mobile app and Web Console on OVHcloud infrastructure in the United States, including storage of survey photos and reports. Other providers process information for the features described in that policy; customer region does not guarantee all processing occurs in that region.
Accepting these Terms does not enroll you in a newsletter or replace a separate consent required for optional processing.
13. Term and Termination
These Terms apply while you use the Services. We may suspend or terminate access for a breach, unlawful use or a security risk, subject to applicable law. Do not evade an account restriction by creating another account.
You may cancel your subscription or request account deletion through support. Account deletion is separate from subscription cancellation; we will address any ongoing billing when handling the request. Access restrictions do not create an unrestricted right for us to retain or immediately erase customer data contrary to the Privacy Policy.
14. Changes and Interruptions
We may update the Services or these Terms and may need to interrupt service for maintenance or other operational reasons. We will post the revised Terms with an updated date and give notice of material changes affecting existing customers as required by law. Applicable mandatory rights continue to apply.
15. Governing Law
For North American customers, these Terms are governed by the laws of the State of Texas, United States. For customers outside North America, they are governed by the laws of Switzerland. The United Nations Convention on Contracts for the International Sale of Goods is excluded.
These choices do not deprive you of mandatory protections or rights available under applicable law, including protections that apply to consumers in their country of residence.
16. Dispute Resolution
First send a description of a dispute to support@routesurvey.app so we can attempt to resolve it. Allow 30 days for a good-faith response before proceedings, except where urgent relief or applicable law requires otherwise.
North American Customers
Subject to mandatory jurisdiction rules, disputes are brought in the state or federal courts located in Harris County or Galveston County, Texas, and the parties consent to that jurisdiction.
Customers Outside North America
Subject to applicable mandatory law, disputes are determined by one arbitrator under the Arbitration and Internal Rules of the European Court of Arbitration, part of the European Centre of Arbitration seated in Strasbourg. The arbitration seat is Oberägeri, Zug, Switzerland; the language is English and the substantive law is Swiss law.
To the extent permitted by law, arbitration is individual and may not be joined with another proceeding or brought as a class or representative action. Disputes about intellectual-property validity or enforcement, theft, piracy, invasion of privacy, unauthorized use, and requests for injunctive relief are excluded from this arbitration clause. The courts of Zug have non-exclusive jurisdiction for excluded disputes or where arbitration cannot be enforced, subject to mandatory rights to bring proceedings elsewhere.
17. Corrections
We may correct inaccurate descriptions, pricing or other errors. Corrections do not override a customer’s mandatory rights or permit an unauthorized charge.
18. Disclaimers
Except for express warranties in the EULA or another applicable written agreement, the Services are provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that content is complete, error-free or suitable for a particular route or movement.
Use professional judgment and follow safety requirements. We are not responsible for independent third-party content or services. Nothing here excludes a warranty or remedy that cannot lawfully be excluded.
19. Limitations of Liability
To the extent permitted by applicable law, we and our personnel are not liable for indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits, revenue or data arising from use of the Services. The EULA’s specific liability provisions govern claims about the mobile application.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable liability for fraud, gross negligence, willful misconduct, death or personal injury. Applicable consumer remedies are preserved.
20. Indemnification
To the extent permitted by law, you agree to defend and indemnify the relevant RouteSurvey App company and its personnel against third-party claims and reasonable expenses arising from your unlawful content, misuse of the Services, breach of these Terms or infringement of another person’s rights. This includes misuse of the app while operating a vehicle. We will provide reasonable notice and cooperate in the defense. This clause does not make you responsible for liability caused by our own unlawful conduct.
21. Customer Data, Export and Deletion
Data retention and export rights are described in the Privacy Policy. Keep your own copies of important survey records and request any needed exports during the applicable retention window. These Terms do not promise a particular backup service, backup frequency or recovery capability.
Deleting an individual team member’s account preserves organization-owned records. Any copies independently downloaded by recipients are outside the active account’s storage and are not automatically erased by account deletion.
22. Electronic Communications
We may communicate service, billing and legal notices electronically through the Services or your contact address. Electronic agreements and records may be used where permitted by law. Optional marketing remains subject to your separate choices.
23. California Users
California users may contact support about a complaint and may also contact the California Department of Consumer Affairs through its official complaint channels. Privacy requests are described in the Privacy Policy. Nothing in these Terms waives rights that cannot be waived under applicable law.
24. General Provisions
These Terms, the EULA where applicable, and any applicable order or written agreement describe the agreement for the Services. The Privacy Policy explains our data practices. A specific written agreement controls a conflict within its stated scope; the EULA controls mobile-license-specific conflicts as explained above.
If a provision cannot be enforced, the remaining provisions continue to apply. Failure to enforce a provision is not a waiver. No partnership, agency or employment relationship is created. Assignment and notices remain subject to applicable law and any applicable written agreement. Clauses intended by their nature to survive termination continue to apply.
